Processing objectives
CodeCapital collects and processes the personal data of customers for customer and order management (in amongst other things including customer administration, order/delivery follow-up, billing, solvency monitoring, the sending of marketing and personalised advertising.

Legal base(s) for processing
Personal data are processed based on (a) consent, (b) necessary for the performance of the agreement, (c) necessary in order to comply with a legal obligation, (f) necessary to uphold our legitimate interest to run our business as set out in the General Data Protection Regulation.

Insofar as the processing of the personal data occurs based on (a) (consent), the customer has the right to withdraw the consent previously given.

Transfer to third parties
Where this proves necessary in order to accomplish the proposed purposes, the customer’s personal data will be shared with other companies (of the CodeCapital group) inside the European Economic Area which are directly or indirectly affiliated with CodeCapital or with any other partner of CodeCapital; CodeCapital hereby offers assurances that said recipients shall put in place appropriate technical and organisational steps to protect the personal data.

Retention period
The personal data processed for customer management purposes will be kept for the time necessary to comply with legal requirements (e.g. in the field of accounting).

Right of access, rectification, erasure, limitation, objection and portability of personal data

At all times, the customer will have the right to access its personal data, to (have them) rectified where they are inaccurate or incomplete, have them erased, have the processing thereof limited and to file an objection against the processing of the personal data relating to it pursuant to article 6.1. (f), with the inclusion of profiling based on said provisions.

Moreover, the customer has the right to be provided with a copy (in a structured, commonly used, machine-readable and interoperable format) of its personal data and to have the personal data transferred to a different company.

In order to exercise the rights detailed above, the customer is invited to:

  • Adjust the settings of its customer account itself; and/or
  • Send an e-mail to the following email address: info@codecapital.be

Direct marketing
The customer has the right, free of charge, to object to any processing of his personal data for the purpose of direct marketing.

Complaint
The customer has the right to file a complaint with the Commissie voor de Bescherming van de Persoonlijke Levenssfeer (Commission for the Protection of Privacy) (35 Drukpersstraat in 1000 Brussels – commission@privacycommission.be).
